And why the hell are they using my pictures without asking OR giving me credit? I honestly don't mind the not asking part, but at least send me a copy of the magazine or at the very least, put my name there. I was at Newbury Comics and for some reason, instict told me to look at the magazine and I am flipping through and bam, clear as day, a picture of From A Second Story Window that I took from Club Marque:



Rev or Carina, how would you handle this? I think I am going to send them an email nicely saying I don't mind them using my pictures, but if they are, I'd appreciate a photo credit or something. Actually, there is another one there from Sick As Sin that I thought was mine, but might actually be one of yours.....

It's still the magazine's fault for not making them agree to making sure everything that is submitted is credited. Which should really be something they start doing because they could get sued easily and without an agreement between the band and their magazine they wouldn't be able to sue the band for fucking them like that. Ahh legal shit. How I love it.

i am very close to this magazine....

i will let you know that the way the mag works is when they are doing a story/review, unless they use a picture that a staff member has taken, they ask the band/label to provide a picture for the story.

the band/label is the one who sent the picture to the mag. The mag has no way of knowing if the pic is one that bands friends took/someone from the label/ a freelance photographer. you should email the band and ask why they are using pictures you took without giving you credit.

I told the band they could use it, I don't mind, and I'm not trying to make a buck or anything, it's just as an individual it can be frustrating to have your work taken advantage of. I just wish I at least knew about it, you know? I'm not really THAT mad at them and I am certainly not mad at FASSW, because if I can help them, that's great, I don't know, it's just the first time I've found something like that and it's frustrating I guess...

unrestrained is one of the best done mags and I've dealt with you in the passed.
I'm thinking it's more about the label sending out the pictures cause I found another uncredited, unasked for picture of myne in one of thier ads.
I also support FASSW whole heartily.

Yeah I not one of those types of people that thinks everyone else is my competition or anything, I am totally cool with using the picture and such, but I guess there's really not much of a way we can really avoid this. I love the FASSW guys so if this helps them then rock on...

it can be avoided if the magazines refuse to accept pictures that aren't credited.

because i mean obviously a member of the band didn't take it and chances are 9 times out of 10 the person who runs press at a label didn't take it either.

and it would be of the magazines best interest to do that because that's how lawsuits happen.

well what about the people submitting the photos?

like the bands or the pr people? i think it is their responsability ultimately...the magazine assumes someone with the band took them...a lot of promo photos you see are not credited..they are done by someone working internally for them...

Even if the magazine is using a promo shot from a hired photographer it should be credited and I think magazines should make sure that happens by not accepting photos from bands if the band doesn't give them the credit for it.

So instead of e-mailing the band to ask for a photo they should e-mail the band ask for a photo and the name of the photographer and stress the fact that the photographer's name MUST be included with the shot.

ultimately it's the magazine's responsibility because they're the ones who'll end up with a lawsuit when they print a photo that has a copyright. And if the magazine tries tries take the band or press guy at the label to court over that, nothing will happen because the magazine never asked the band for the photographers name.

you don't see CD's without the engineers name in it. The same should be done with photographers.

hey i'm agreeing with you....i'm a photographer and this shit pisses me off..but the fact of the matter is that it's not ultimately the magazine's fault..it the person giving the pics to the mag..it's happened before and that's what i found out

Or they can just have their own photographers take pictures for them? Not trying to sound like a dick or anything, I had heard of this magazine before but this was my first time actually seeing it, and it looks like they do a solid job...

unrestrained is done by basically 2 guys,
they aren't metal manics (though mr. energize bunny rights in mm too) and they won't never had the budget for their on photographers.
heck, they are canadian for god sake!

I'd offer up my work for free just to have my name and link out there, I don't care personally. I've never been in this for money and I'm not going to start now. I am flattered that a picture I took was deemed worthy of print, I guess I selfishly want my name attatched to it, and I don't think I'm wrong for feeling that...

yup.... there are two editors... adrian and adam... they started this mag because as they were working on other projects (MEAT magazine and Chronicals of Chaos) they decided they wanted to try it on their own...

there are a few staff writers... predominately friends of the two... layout is done by a bud, accounting by a bud, etc...hell when its time to mail out mags...they have a packing party hahah where everyone on staff who can goes to one of the editors house and they stuff mags, write addys out and mail them out

this mag has improved sooooo much from the begining... hell the first issue was non glossy black and white.

there is soooooo much that goes on behind the scenes of this mag that no one could possibly understand.... and while i understand the "well ask for a pic and name" i really believe the labels/bands should be voluntarily giving this name out... they know damn well that the pic is most likely going to be published.... and they know someone took the pic....and most like who. its very easy for them to say photo by.... or in the case of rev's... they CUT OFF HIS COPYRIGHT... yup the band reduced the pic so the copyright was gone.... soooo yup all i got to say

i was picking up my apt today and stumbled across some promo pics that labels had mailed to a friend who is an editor of another mag...

so out of the five pics i have only two had photocredit and they were both from Nuclear blast... you guys might want to contact labels/bands and let them know you expect credit when your photos are used.

Hey I respect anyone that does this, because all it does is helps the bands, and that's all I care about. With my site, I don't think of myself as a critic as much as I do a fan trying to promote some of his favorite bands. But anyway, I guess I'm just mad at them because I don't want to be mad at FASSW, haha.

rev you should get a REAL watermark for your pictures. have it cover the entire picture. hahha.
